Plaintiff's Claims
A Plaintiff's claim is what is filed and served to commence a lawsuit. If you believe someone has violated your rights and caused you a loss, or you believe that they owe them money, you will need to draft this to start a lawsuit. Plaintiff's claims need to be precise, and worded correctly. They cannot contain any inaccuracies, and can be confusing to someone not well versed in law. Give us call, we'd be happy to help you!
Defences
A Defence is a form that must drafted if you intend to dispute the allegations made in a Plaintiff's claim. There are time limits for responding to the Claim that has been made against you. Your Defence must be drafted and filed with the correct court within 20 days of being served with the Plaintiff's claim. Defendant's Claim
If you are being sued, you can file a claim of your own by filing a Defendant’s Claim. This is a claim made by the defendant against the Plaintiff or another person. If you are being sued by someone and you have a reason to sue them, you would need to draft a Defendant’s Claim against the plaintiff. However, if a plaintiff sues you in error, and you believe that another person is responsible for all or part of what the plaintiff is claiming, you are able to bring that individual into the lawsuit. Issues can arise before or during trials, which need to be resolved before the trial can proceed. To resolve these issues, a motion must be made.
